WAIVER OF LIABILITY AND DOCK SPACE RENTAL AGREEMENT

This acknowledges that payment will be sent to Hilltop co-op in the amount of $ (check box, see below). The rental space may not be used under any circumstances prior to payment received by Hilltop. This payment is for rental of a dock slip controlled by Hilltop Park Cooperative, Inc., (hereinafter “Hilltop”). It is specifically agreed that renters may have use of a slip, as designated by Hilltop. Renters accept the slip “as is”. Renters accept the property owned by Hilltop “as is”. Regardless of whether negligence is attributable to Hilltop or the Renters, the Renters agree to hold Hilltop harmless and indemnify Hilltop for any settlement or judgment that results from injuries that may result to Renters, or their guest. Hilltop, at its discretion, reserves the right to terminate this rental agreement for any reason. Should the rental agreement be terminated, a pro-rate refund will be provided. However, if the rental slip is utilized or terminated on or after August 1st, then the entire rental fee is forfeited should the rental contract be terminated by the renters or by Hilltop. Should a refund occur, it would be calculated by dividing the total rental amount by 6 months, and refunding the unused portion of the rental fee for the remaining months. Once the Dockmaster has assigned the garage space to the renter, and this form is completed by the member, the Hilltop Park Treasurer will send the invoice to the renting member with due date noted on invoice. The rental space may not be used under any circumstances prior to payment received by Hilltop. This waiver of Liability and rental Agreement constitutes the entire agreement between the parties. Renters acknowledge that she/he/they have read and understand this rental agreement. Renters accept the terms and conditions of this Waiver of Liability and Rental Agreement. This agreement is not transferable.
